Grant Disability Pension to personnel injured during Annual Leave : High Court

In an important decision, the Punjab & Haryana High Court has held that even personnel suffering injuries during annual leave are to be awarded disability pension and that such injuries if not due to negligence / illegal action of the individual himself, shall be deemed to be 'attributable to military service'.

Sir,
This is on Indian Tolls Act for Army & Air Force 1901. Recently, I was on my way to Chandigarh from Ambala on official duty in a private vehicle, at Dera Bassi Toll point, I was charged Rs 21/- for using the road. At that point of time, I enquired whether the manager who was on duty was aware of the Act or not. He replied in positive and said other than military vehicles no private vehicle of defence personnel is allowed to ply free of charge. in this connection I made a couple of queries with CE PWD (B&R) Patiala through email but there is no reply. Kindly guide me what action should be taken to permit the vehicle of serving defence personnel to use the bridge/road with out paying the toll as per the Act.

Sir.

This is one Rect/Clk invalid out of Service due to medical Board on 1986, and a disability pension is sanctioned. After the Vth pay commmission a minimum pension is sanctioned.I have only a six months service. Please let me know about the increse in pension regarding the VIth Pay commisssion and the disability was less than 20% AFTER THE MEDICAl bOrad in 1987

Could we please keep the posts relevant to the original post.
I request a clarification please. What course of action is available to the disabled soldier if the court of inquiry has decided that the disability is not attributable because it was sustained during annual leave. Assuming there is no negligence or any such exclusion involved.

The only course of action is an Hon'ble Court of Law.
