Latest changes in Travelling Allowance rules related to transportation of personal effects, and anomalies therein

The rules and rates for claiming TA for transportation of personal effects have been revised. The discussion on the same has remained quite heavy on the chat box and hence I thought of providing the link to the latest changes. The new letter issued by the Ministry of Finance on the subject can be accessed by clicking here.

A friend has pointed out a very pertinent anomaly in the said dispensation, here it is in his own words :

“Different rates have been prescribed for X & Y class cities on one hand and Z class cities on the other hand. This has created an anomalous situation where personnel posted from a Z class city which is further away than an enroute Y class city will get a lesser amount. For example, if a person (eg Sub Maj) drawing grade pay of Rs. 4800 is posted from Udhampur (Z class) to Delhi, he will be entitled to Rs 11592 as the distance between these cities is 644 Kms. Another Officer of same Rank when posted from Jammu to Delhi (distance 620 Kms) will be entitled to Rs.18600/-. It may be noted that hiring of truck/transport from Udhampur to Delhi is always more expensive than hiring it from Jammu to Delhi. The situation becomes more absurd if these Officers are posted to far away places like Guwahati. The distance of Guwahati from Jammu and Udhampur is 2315 Kms and 2381 Kms respectively. The entitlement works out to be Rs.69,450/- and Rs.42858/-. The lower entitlement from a farther away place on same route is clearly anomalous.”

A very valid point. Perhaps it is time for another clarification and amendment to the original OM. The ibid clarification has taken about two years, let’s see how much one has to wait for this one…

RR: Rate from Udhampur to Delhi will be at the rate of Rs 18 per Km but from Delhi to Udhampur, it will be Rs 30 per Km. How funny!Transporters will charge more or less same for both destinations.

babus at their best in applying LOGIC....post them to places like dinjan.. they'll realise its more expensive to hire trucks to a remote place (class Z location)or vice-versa than from a big city to another big one.. idiocy...

As per travel rules the truck/transport can be hired from either originating station or destination station. So these anomalies are actually non existent. The person posted from Udhampur to Delhi and Jammu to Delhi should hire transporters from Delhi and make claim accordingly. The higher category of The either of the station is considered for making claims.

Moreover, the Hon'ble AFT, Chandigarh Bench, has already ruled and decided that pre-2006 Hony Nb Subs cannot be refused the benefit of the pension of a Naib Sub.

I am of the opinion that it is not correct to fix the per-km rate for hiring a civil tpt.A transporter will quote his rate to maximise his profit in the given market scenario.Competition,geographic location of points of collection and delivery,costs of hauling empty vehicle from market to point of collection/from point of delivery to next market, fuel costs enroute,civil disturbaces enroute are some of the factors that go in deciding the Quotation.Even getting a tpt for Govt Duty inspite of existing Annual Rate Contracts becomes difficult in the event of steep increase in fuel price. I recall that an automatic refixation of hiring rate of tpt @ 30 paise per Rupee increase in cost of diesel was accepted by Auditors in the ninetees.An accommodative approach to determine Govt liability of reimbursement of hiring cost in relation to location of origin and destination needs to be adopted.It could be related to the location of Peace Stations at either end.

can any body clarify if elegibility for substantive promotion is checked from date of occurance of vacancy/completion of no. of years OR eligibility is checked on the date of holding the board(which takes nearly 3/4 yrs at times)

can something be done about the Road Mileage Allowances? CDA accepts only the local taxi rate at the starting station. unbelievable, but rates are Rs 2 a KM at some places. local RTOs have not revised the rate for decades. can someone do something about it?

From when is this order coming into effect. I checked with my organisation and they said that only when the orders will be passed by CDA, the said rates will be applied.

Prior to 6th CPC, basic entitlement of TA claim for transportation of personal effects was limited to charges levied by rly + 25% thereof, if both places were connected by rail. If not, there was a rate prescribed on per km basis. Post 6th CPC, ( referMin of Fin, Dept of Expdr letter No 19030/3/2008-E.IV dt 23 Sep 2008), apparently, this situation has not changed as this letter states in it's first para that Traveling Allce rules are being merely modified. Only difference is that now rates for transportation of personal effects by road, where rail connectivity does not exist, have been enhanced.
This is my understanding of the situation. Please correct me if I am wrong.
Introduction of discriminatory rates is arbitrary for reasons pointed out by many others on this site. This matter too needs to be taken to Anomalies Committee,
