Update on the issue of illegal withdrawal of Toll Tax Exemption from serving defence personnel

Just to update all of you, in continuance of my detailed letter to Mr Nitin Gadkari, I have received a communication from the Ministry of Road Transport & Highways inter alia conveying therein that they are open to re-examining the issue of the (illegal) withdrawal of toll tax exemption to serving defence personnel and that they have sought comments of the Ministry of Defence/Army HQ on the same. Further action shall follow once the comments are received.

I have already requested the Services HQ to fast-track the matter and ensure that the impugned illegal letter is withdrawn at the earliest.

I hope and wish that due seriousness is shown on the subject by the Services. I have already expressed my sentiments on the duty of the Services HQ of standing behind their men and women in uniform on such issues.


Will keep readers updated on the subject.

Today while traveling from Jhajjar to Rewari on National Highway connecting Panipat - Rohtak - Rewari I was charged Rs. 65/- as toll tax by Rewari Toll Plaza, who have given a copy of Reply by the NHAI to RTI made by the Toll Operator Wherein some Secretary has opined that 'private vehicle' of the Army Petsonnel is not exempt if said personnel is not 'On Duty'. I plan to file a suit in Hon'ble HC of Rajasthan claiming compensation as also quashing of impugned Reply. Those wanting to make it a Class Suit are most welcome to join. Advise is also welcome.

Actually I as a veteran of 1992 retiree and have taken part in 1962, 1965 , 1971 operation and having retired with pride , the HIGH WAY authorities /surface transport authorities should exempt us from this toll tax as a special case. how long will we live those who passed 70s? At least it would keepour self esteem high. the DEFENCE HQ should include this to the Surface transport authorities while giving their comments.

Could the Indian armed forces have a scheme of reimbursement of higher education expenses incurred before joining as short service comm officer and then releasing them after say 5 years without pension, and after 14 years with pension payable for say next 10 years(not whole life ) . Higher education expenses being so high these days 5 years service as a short service commissioned officer could be an attractive proposition.

The Top Brass donning the OG is not serious about the issue since its too frivolous for them and its this attitude that has led to the present low of the services. The bureaucracy derives sadistic pleasure humiliating us because we have lost face at MoD. We take nonsense from them thinking he is a civilian officer and so is expected. Believe you me a civilian non government employee will take no insult the way our top brass do just to be goodie little two shoes with them. And this toll exemption .....let's forget about it.

Aftet serving for 33 yrs and when age restrict for getting anyother income other then small pension,why Gov. Is punishing us by taking toll tax without providing some other road which i can take to Pun, from were ever you go you to pay toll.

Sir, you are doing a great job. But the Govt is doing nothing. You have written the letter in Oct 14 and no further action has been done by NHAI. Still the toll tax is being collected.
Its a wake up call for all of us. Why the Govt shows so much lethargy in dealing with the so called FAUJIs? Is it that because we are bound by rules?

i read news in times of india dtd 24 feb 15 saying AFT has given stay on illegal withdrawl of toll tax exemption to defence personnel..how can i get copy of stay order given by AFT for availing toll tax exemption

EXEMPTION SHOULD ONLY FOR RETIRED AND SERVING INJURED . OTHERS SHOULD PAY LIKE ALL PROUD INDIANS AND PAY TAXES. GOVT SHOULD HOWEVER ENHANCE THE PENSION PAID AND PAY HANDSOMELY TO BOTH SERVING AND RETD

If CPC wasn't enuf the toll drama is back. NHAI operated toll barriers collecting toll from Faujis. They in receipt of letter from NHAI to follow circular of 2014.

I travelled from Chandigarh to Hyderabad by road on my own vehicle last week and found that no questions were asked at the tolls situated in Punjab, Haryana, UP and Telangana after seeing my Id card. However, in MP and Maharashtra I found the toll staff not accepting the exemption and demanded payment of toll tax. They were showing some letter issued on 17 June 16 in this regard by NHAI(I think so) which states that defence personnel travelling in their own vehicles are not exempted from paying tax. I some how persisted that this is not the correct position on the issue and did not pay. However. I request you to state the latest position in this regard.

Dear Sir,
Lots of compliments to you for all the fights you are putting up for the rights of the armed forces personnel.
Inspite of the stay order by AFT on 'cancelling toll exemption to defence personnel by NHAI' published in TOI dated 24 Feb 2015, few toll plazas are still charging toll tax from serving defence personnel. There is obviously no outcome of arguments with the toll plaza operators till the time the instruction is received from NHAI to exempt defence personnel in private vehicles. When do we expect NHAI to give instructions to these people to stop charging toll tax or a new letter which supersedes letter of 17 Jun 2014.
In case there is any present document which can be produced for toll exemption, kindly update us.

Dear sir I was travelling on nh-27 From Lucknow to Basti . at faizabad toll the operator asked 2 pay toll charges. Please orovide the direction to nhai in this concern. Regards

Sir,
May I know the current status as regards to payment of toll tax by serving army personnel while travelling in their personal vehicle. The toll plazas around Bangalore have started charging the same based on the authority of "withdrawal of exemption" letter issued by ministry in May 2014.

If a uniformed personnel is travelling on a hired vehicle, say Ola cab, is he/she authorised for toll tax exemption? If not, how does one travel when on temporary duty?

Also during a posting, some toll plazas insisted that the trucks carrying goods pay toll tax. Is that valid? Can the booth owner be challenged?
