Since the PB 3 is from Lt to Maj, so would there be any difference in calculation of pension for a Lt and say a Major? The reason for asking this query is that if I have to find mine, then since I was in the Rs 9600-300-11400 (pre 2006 pay band), so would the pension of a captain be calculated on Rs 15600 (minimum of the entire PB3 i.e 15600-39100) or Rs 17400 (i.e the stage in the revised PB; refer Table 2.3.1 of Report of 6th Pay commission dated march 2008)? These decisions could/ should have been taken much earliar, I am hopeful that BB case too will be resolved soon.Although i am deadly against BABUS taking unduly long time to decide cases but it appears they are getting around slowly and slowly to our way of thinking . Thank you very much for th...My dear Maj Navdeep,<br /> Thank you very much for the very uplifting post.Before going further Imust say that you and your blog is a blessinng to us.<br /> The Govt have now granted the benefit of calculation of disability pension on perccentage basis as opposed to the existing slab system wef 1-1-2006 to all Defence disability pensioners who were discharged/retired on completion of terms of engagement/superannuation.They have, however,not granted the more beneficial method of rounding off/broadbanding of the disability percentages.This has been granted,through an earlier order,only to the 'ínvalided out'Defence disability pensioners. Compare this to the fact that the percentage system was introduced for the civil disability pensioners since the Vth CPC.Rounding off/broadbanding of disability percentages was granted to all the civil disability pensioners in 2001, if Iam not wrong. Defence disability pensioners who were/ are discharged/superannuted on completion of the terms of engagement continue to be shortchanged.<br /> However, Regulation(para 179 and 53 ?)provide that Defence personnel in Low Medical Category at the time of retirement are also 'deemed' to be 'invalided out' for the purpose of disability pension (I have relied on your earlier posts).This has been upheld by the Hon'ble High Court also.Hence, there is no room for a class distinction between 'Ínvalided Out' and 'Discharged/Superannuated' personnel. Thus the Govt's action not granting the benefit of rounding off/broadbanding of disability percentages to Defence disability pensioners discharged/superannuated from service is arbitrary and flawed.Also,as compared to the civil disability pensioners, the Defence disability pensioners who are discharged/superannuated are still at a great financial disadvantage.<br /> The affected Defence disability pensioners will greatly appreciate if you could give this anomaly/inequity some attention and suggest if a remedy is available/possible. Gener...@Anon 12.58 P.M. and 7:29 P.M. of 27 Feb 11,<br />Generally speaking, Enhanced Rate(of Ordinary Family Pension) would be half of Liberalised Family Pension.<br />In both cases, the Reckonable Emoluments contain an element called the Last Drawn Pay.<br />But the definition/interpretation of the term, of Last Drawn Pay has undergone a change( for all those who retired prior to 01/01/2006), post 01/01/2006. As per the new definition,it is the minimum of the 6th CPC Pay Band in which, pay of the officer would fall.<br />One rider to the quantum to the Enhaned Rate is, that it would be limited to the amount equal to Retiring Pension or Retiring/ Invalid/ Service Element of Disability Pension<br /><br />Thus the Enhanced Rate of ( Ordinary Family Pension) would be 50% of (the minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay ,wherever applicable), for pensioners of Pre 2006 vintage.<br /><br />See below, for explanation of the terms:- <br /><br />[Enhanced Rate of Ordinary Family Pension:-<br />Enhanced Rate - Where on officer dies while in service having rendered not less than 7 years continuous qualifying service, or who dies after retirement with pension. Ordinary family pension at enhanced rate shall be granted for a period of 7 years or upto the date on which the deceased would have attained the age of 65/67 years.
